Terms of Service

These Terms of Service ("Terms") govern your use of SellPass at https://mail.sellpass.net (the "Platform"). By creating an account, opening a store or buying from a store on the Platform, you agree to these Terms.

1. What SellPass is

SellPass provides software that lets independent sellers ("Sellers") run online stores and sell digital goods and services to buyers ("Buyers"). Unless a page clearly says otherwise, SellPass is not the seller of the products listed in stores. Each store is operated by its Seller, who is responsible for its products, descriptions, delivery, support and refunds.

2. Accounts

  • You must be at least 18 years old (or the age of majority where you live) to open a Seller account.
  • Keep your login details and two-factor codes secure. You are responsible for all activity under your account.
  • Provide accurate information and keep it up to date. We may ask Sellers to verify their identity.

3. Sellers

  • You may only sell goods and services you have the right to sell, and only in line with our Acceptable Use Policy.
  • You are responsible for your listings, pricing, taxes, delivery, customer support, refunds, chargebacks and compliance with the laws that apply to you and your customers.
  • You connect your own payment provider accounts. Payments for your sales are processed by those providers under their own terms; SellPass does not hold your sales revenue unless explicitly stated.
  • Plan fees and per-order platform fees are shown on the pricing page and in your dashboard. Unpaid fees may lead to limits on, or suspension of, your store.

4. Buyers

  • Your purchase contract is with the Seller of the store you buy from. Contact the Seller first about any problem with an order (use the store's contact page or the customer portal).
  • Digital items are usually delivered immediately after payment. Refunds are governed by the Seller's own policy and our Refund Policy.

5. Prohibited conduct

You must not misuse the Platform, including by attempting to gain unauthorised access, interfering with its operation, committing fraud, infringing others' rights, or using it for anything illegal.

6. Suspension and termination

We may remove content, limit features, withhold access or suspend or close accounts that break these Terms, our policies or the law, or that put Buyers, Sellers or the Platform at risk. You may close your account at any time.

7. Intellectual property

The Platform software, design and brand belong to SellPass and its licensors. Sellers keep ownership of their content and grant us a licence to host and display it to operate the Platform.

8. Disclaimers and liability

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, SellPass is not liable for indirect or consequential losses, or for products, services or conduct of Sellers and Buyers. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes

We may update these Terms from time to time. We will post the new version here and, for significant changes, notify Sellers by email or in the dashboard. Continuing to use the Platform after a change means you accept the updated Terms.
